Il contributo affronta uno dei profili più delicati delle richieste di differenziazione avanzate delle Regioni Emilia-Romagna, Lombardia e Veneto, concernente il settore farmaceutico. Dopo aver richiamato i contenuti delle bozze di intesa a questo riguardo, l’Autore si sofferma sulle potenzialità e sui limiti della maggiore autonomia in quest’ambito, sottolineando come, accanto all’opportunità di valorizzare le esperienze regionali più virtuose, anche gli insuperabili vincoli derivanti dalla competenza statale in materia di livelli essenziali delle prestazioni.
This paper deals with one of the most thorny profiles of the requests for differentiation advanced by the Emilia-Romagna, Lombardy and Veneto Regions: the pharmaceutical sector. After recalling the contents of the draft agreements in this regard, the Author focuses on the potential and limits of greater autonomy in this area, underlining how, alongside the opportunity to enhance the most virtuous regional experiences, there are also the unsurpassed constraints deriving from the State competence regarding the national standards of health-care services.
