L’obiettivo di questo studio è verificare se e come l’approccio One Health abbia influenzato i contenziosi climatici. La ricerca è strutturata in quattro parti. La prima effettua una revisione dei contenziosi esistenti a livello mondiale, al fine di verificare in quanti di essi il tema della tutela della salute umana sia stato rivendicato dalle parti nella prospettiva One Health. La seconda descrive i due principali indirizzi interpretativi elaborati dalle dottrine giuridiche sul tema. La terza osserva come la prospettiva One Health abbia rafforzato le pretese soggettive alla decarbonizzazione nel c.d. “Nord del Mondo”, e la quarta è dedicata ai paesi del c.d. “Sud del Mondo”, dove i contenziosi climatici associano il tema della salute umana a quello della tutela di interi gruppi vulnerabili nell’opzione verso i c.d. “diritti della natura”.
The objective of this study is to investigate whether and how the One Health approach has influenced climate change litigations. The research is structured in four parts. The first carries out a review of existing litigations worldwide, to verify where the theme of human health protection has been claimed by the parties from the One Health perspective. The second describes the two main interpretative approaches developed by legal doctrines on the issue. The third observes how the One He-alth perspective has strengthened the subjective claims to decarbonisation in the so-called “Global North”, and the fourth includes the countries of the so-called “Global South”, where climate litigations associate the issue of human health with that of the protection of entire vulnerable groups in the option towards the so-called “rights of nature”.
