Le linee guida compaiono in molteplici settori del diritto, senza che si possa individuare una definizione univoca e uniforme, caratterizzati da flessibilità ed atipicità. Mutano nella propria essenza a seconda delle esigenze contingenti. In alcuni casi provengono dal legislatore (si vedano le linee guida connesse alle misure nell’emergenza Covid-19), in altri da Autorità indipendenti (si vedano le linee guida ANAC), in altre ancora da entità varie e prive di riconoscimento di diritto pubblico (quali Associazioni e Società scientifiche delle professioni sanitarie, ai sensi dell’art. 5 legge 24/2017). I casi proposti consentono di rappresentare la natura multiforme e caleidoscopica di tali atti. Il problema è certamente quello di far convivere i principi tradizionali con le nuove categorie giuridiche, il cui significato dipende indubbiamente dall’ambito applicativo, dall’obiettivo e dal dettato normativo che le prevede, nonché dagli effetti che la normativa attribuisce ad esse.
The guidelines appear in many sectors of law, without being able to identify a single and uniform definition, characterized by flexibility and atypicality. They change in their essence according to contingent needs. In some cases they come from the legislator (see the guidelines related to the measures in the Covid-19 emergency), in others from independent Authorities (see the ANAC guidelines), in others still from various entities without recognition of public law (such as Associations and Scientific Societies of the health professions, pursuant to Article 5 of Law 24/2017). The cases proposed allow us to represent the multifaceted and kaleidoscopic nature of these acts. The problem is certainly that of making traditional principles coexist with the new legal categories, the meaning of which undoubtedly depends on the scope of application, the objective and the normative dictation that provides for them, as well as the effects that the legislation attributes to them.
