In recent years, the regulation of the Italian gambling system has progressively shifted from the principle of health protection to the primacy of fiscal revenue, marking a regression in public policy. This contribution retraces the regulatory and institutional evolution of the sector, from the phase inaugurated by the so-called “Balduzzi Decree” to the most recent legislative choices, which have reduced the effectiveness of prevention and monitoring tools. Within this framework, the study highlights how the tension between fiscal objectives and the protection of health requires a reconside-ration of the Third Sector as a constitutional safeguard and a factor of systemic balance. In light of Article 55 of the Third Sector Code and the principle of horizontal subsidiarity under Article 118 of the Constitution, the paper shows how Third Sector entities operate as infrastructures of proximity capable of reconnecting public health with collective responsibility.
